Official Rules & Regulations
- No purchase is necessary to enter or win this contest. Catch. Click. Win. ("Contest") brought to you by Pure Fishing, Inc. Canada starts at 00:00:01 a.m. Eastern Time ("ET") on June 1, 2010 and ends at 11:59 p.m. ET on August 31st 2010. The Sponsors of this Contest are Pure Fishing, Inc., Canadian Tire Corporation, Berkley, Lund Boats, Coleman Canada, Deep Woods Off, Real Fishing (the "Sponsor"). The Contest shall be subject to these Official Rules and Regulations (the "Rules") available at www.CatchClickWin.ca (the "Website"). By entering all participants agree to be bound by the terms and conditions of the Rules. Entrants who do not follow the Rules will be disqualified.
- ELIGIBILITY. CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF CANADA; who have reached the legal age of majority according to their province/territory of residence AS OF THE DATE OF THEIR ENTRY; except employees of Sponsor including but not limited to Canadian Tire Corporation, Limited, Canadian Tire Associate Dealers, Canadian Tire Petroleum Agents, Mark's Work Wearhouse (collectively, the "Canadian Tire Parties") its advertising and promotional agencies, the independent judging organization, and members of their respective immediate families living in the same household; subject to approval from the Regie des alcools, des courses et des jeux regarding the Province of Quebec. ALL ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON AUGUST 31, 2010. Odds of winning depend on the number of eligible entries received.
- ENTRY FORM. Entry form available online at www.CatchClickWin.ca (the "Website"). Fill in your name, complete mailing address, phone number, age and upload photo to the category you wish to have it entered in. Contest categories include: 1. Family, Friends & Kids - portrayal of these people enjoying fishing; 2. Relaxing - portrayal of anglers taking it easy in the great outdoors; 3. Heritage - photos from years past; 4. Nature - shots of lakes, wildlife and landscapes; 5. Big Fish - images holding fish. Photo submissions can also be made in these same categories via regular mail by sending all information above, including a full colour copy of the photo, to "Catch. Click. Win. Contest" c/o Izumi Outdoors Inc., 940 Sheldon Court, Burlington, Ontario, L7L 5K6. Entry deadline for the contest is 11:59pm, ET, August 31, 2010 (the "Contest Closing Date"). To request an entry form mail your request, include a self-addressed stamped envelope, to "Catch. Click. Win. Contest" c/o Izumi Outdoors Inc., 940 Sheldon Court, Burlington, Ontario, L7L 5K6 and an entry form will be mailed to you. Mail in entries limited to one per envelope. Entry deadline for the weekly draw begins at 11:59 pm, ET, June 7, 2010 and follows consecutive Mondays until 11:59pm, ET, August 30, 2010. Limit of one entry per category per person, 10 per household. Photos will be accepted only from the original photographer. Photographs that are claimed to have infringed any third party's rights will be disqualified. Digital photos shot with a camera must have a minimum resolution of at least 3 mega pixels. Digital photos that are scanned must be scanned at a resolution of at least 300 lines per inch or equivalent with a minimum output size of 5x7". All electronically submitted photographs must be in JPG format, maximum file size of 5 MB.
By submitting a photograph, you do hereby grant, convey, sell, assign, and transfer to Sponsor, its successors and assigns, as assignee, all of your right, title, and interest in and to the photographs, the copyrights to the photograph(s), any registrations and copyright applications relating to the photograph(s) and any extensions and renewals thereof, all droit morale rights to the photographs, and any derivative use of the photograph(s), including, but not limited to, the sole and exclusive right of copying, engraving, reproducing, and multiplying the photograph(s) in any form in any medium. You further warrant and represent that: (a) you are the sole owner of the photograph(s), including but not limited to, all copyright rights therein; (b) you have the authority to enter into this assignment; (c) this assignment does not infringe any third parties rights; (d) the photograph(s) have not been published in such a way as to lose any of its copyright protection; and (e) there is no pending or threatened lawsuits concerning any aspect of the photograph(s). You hereby confirm that upon submission of the photograph(s), Pure Fishing Canada and its successors and assigns, shall own the entire title, right and interest in the photograph(s) free of any restrictions, including the right to reproduce, prepare derivative works based upon the copyright in the photograph(s), distribute by sale, rental, license, lease or lending or by other transfer of ownership, to display, and to make publicly available for download by means of the Internet. You retain no rights in the photograph(s). Sponsor is not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; congestion, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any Website; printing; administrative or other errors of any kind or any combination thereof. Proof of entering information at the Website is not considered proof of delivery or receipt. Illegible, incomplete and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Rules and with the Sponsor's Online Privacy Policy.
- PRIZES. Subject to the receipt of sufficient eligible entries, Sponsor will award: one (1) GRAND PRIZE for best overall photo judged from all images submitted and one (1) SECOND PLACE and one (1) THRID PLACE prize, runner-ups to the GRAND PRIZE. GRAND PRIZE consists of: one (1) WC 16 DLX Lund fishing boat and Shoreland'r galvanized trailer complete with 30hp ELHPT Mercury motor (approximate retail value of the Lund boat is $11,000) and one (1) $2500 prize package from Pure Fishing Canada, Coleman Canada, SC Johnson Canada and Real Fishing. Approximate retail value of the GRAND prize is $13,500. One (1) SECOND PLACE consisting of one (1) product prize package worth $2000 of products from Pure Fishing Canada, Coleman Canada, SC Johnson Canada and Real Fishing. One (1) THIRD PLACE consisting of one (1) product prize package worth $1000 of products from Pure Fishing Canada, Coleman Canada, SC Johnson Canada and Real Fishing. There are thirteen (13) WEEKLY PRIZE packages to award through random draws. A WEEKLY PRIZE package is valued at $700 each from Pure Fishing Canada, Coleman Canada, SC Johnson Canada and Real Fishing. Total approximate retail value of all prizes to be won is $25,000. Due to inventory control and/or product development Sponsor reserves the right to substitute any item with one of greater or equal value.
- WINNER SELECTION. All eligible photos will be judged by a panel of four (4) judges which include Bob Izumi, Wayne Izumi, Mark Harrison and Chris Hockley. A decision will be made regarding the GRAND PRIZE, SECOND PLACE and THIRD PLACE prizes on September 15, 2010 at 5:00 p.m., ET in Burlington, ON Canada. Winners of the thirteen (13) weekly prizes will be randomly selected from all eligible entries starting June 8, 2010 at 5:pm ET in Burlington, ON Canada and follows consecutive Tuesdays until August 31, 2010. In order to win the selected entrant must first correctly answer a time-limited, mathematical, skill-testing question without assistance or mechanical or electronic aid. You may only win one weekly prize package per household. All decisions of the judging panel are final.
- WINNER NOTIFCATION. Winners of the GRAND PRIZE, SECOND PLACE and THIRD PLACE will be notified by telephone and/or email on September 16, 2010. Winners of the thirteen (13) weekly prizes will be notified by telephone and/or email starting on June 9, 2010 and follows consecutive Wednesdays until September 1, 2010. Winners will be required to complete, execute (notarize) and return a standard Affidavit of Eligibility, a Winner's Release and Assignment Form confirming compliance with these Rules and acceptance of the prize as awarded and if required such other agreements as are necessary to secure for Sponsor the rights required by the Rules, including a Model Release form to be completed by all individuals depicted in the winning photo. The Affidavit, Winner's Release, Assignment form and Model Release form if applicable must be returned within 14 days of receipt. Failure to return all required documents in this time period will result in the winner being disqualified and an alternate winner selected. In the event that a selected entrant is disqualified from eligibility, does not correctly answer the mathematical skill testing question within the time limit or cannot be contacted by the Contest Sponsors within two (2) business days. Contest sponsors shall have the right to redraw/select another entrant to be eligible to win.
- PERSONAL INFORMATION. Information gathered from the online entry form will be used by Sponsor in connection with the Contest and in accordance with Sponsor's Online Privacy Policy. By entering the contest, each entrant consents to the use of their name, address (city and province only), likeness (photograph) and statements by the Sponsor without compensation or limitation.
- Sponsor reserves the right to terminate or modify the Contest in any way that it deems to be fair and equitable in the event of an occurrence which may materially affect the proper play of the Contest. Any complaint respecting the conduct or organization of this Contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any complaint respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
- Subject to paragraph 8, if for any reason this Contest is not capable of running as planned, or if this Contest or any Website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries per these Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Contest or any portion thereof. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Website. Any attempt by any person to deliberately damage any website or undermine legitimate operation of the program is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to disqualify and seek damages from any such individual to the fullest extent permitted by law. In the event of dispute over source of any electronic entry, the entry will be attributed to the authorized account holder of the email account. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
- No substitution for, or transfer of, or cash equivalent of, prizes will be allowed. The chances of being selected depend upon the total number of entries received. Void where prohibited. The contest is subject to all applicable Federal, Provincial and Municipal laws.
